Title after purchase

Paying Wohiri for a plot is the start. Under the Land Use Act 1978, the governor holds the land. You get a right of occupancy. This page is the work that puts that right in your name — Certificate of Occupancy, or a registered Deed of Assignment with Governor’s Consent.

This is a buyer checklist, not legal advice. Processes and fees differ by state. Use a property lawyer in Lagos or Abia, depending on the plot. Wohiri supplies the sale file; Lands Bureau records the title.

Two different files

Track A

Estate already has a C of O

You do not apply for a new C of O. You perfect the transfer: deed, stamp duty, Governor’s Consent, then registration.

Track B

No C of O yet

You (or Wohiri with you) apply for a Certificate of Occupancy in your name at the state Lands Bureau, then register it.

Ask us in writing: what is the root of title — C of O, gazette, excision, or allocation only?

What Wohiri should give you

Keep originals. Scan everything.

Payment receipt
Allocation letter proving you bought that plot number.
Contract of sale
Estate, plot, size, and price in writing.
Deed of Assignment
The transfer instrument. Wohiri or the company signs.
Registered survey
Your name, beacons, coordinates, square metres.
Estate layout
Ties the plot to Daa Rhoda or the scheme you bought.
Root title CTC
C of O, gazette, or excision — proof the seller had title.
Company papers
If the seller is a company: CAC status and a resolution to sell.

Work to actually own the land

  1. 01

    Search and chart

    Your lawyer searches the Lands Registry. A surveyor charts the plot at the Surveyor-General: no government acquisition, no overlap, beacons on ground, layout approved. If charting fails, stop.

  2. 02

    Deed of Assignment

    Lawyer vets the deed. Both sides sign. Company seal and board resolution if Wohiri sells as a company. Attach the survey. Until this is signed you only have a receipt.

  3. 03

    Stamp the deed

    Pay stamp duty. Unstamped deeds are weak in court and the registry will refuse them.

  4. 04

    Track A — Governor’s Consent

    Use this when the estate already has a C of O. You are assigning the remaining term, not creating a new grant.

    • Land Form 1C in Lagos, or the Abia consent form, sworn
    • Three copies of the deed, CTC of the C of O, chartable survey
    • Tax clearance (often three years), IDs, photographs, NIN
    • Inspection and assessment, then pay consent and registration
    • Governor (or delegate) endorses consent; register the deed
  5. 05

    Track B — apply for a C of O

    Use this when there is no C of O yet. File at Lands Bureau (Abia: Umuahia or Aba office). Expect inspection, publication, assessment, ground rent, then a 99-year C of O in your name. Stamp and register it.

  6. 06

    Collect the pack, then build

    C of O or consented deed, registered survey, receipts. Then building-plan approval and estate covenants — not before.

The pack you should hold

  1. C of O, or a certified true copy of the estate C of O
  2. Deed of Assignment
  3. Governor’s Consent, if it was a transfer
  4. Registered survey in your name
  5. Evidence of registration (registry number / stamp)
  6. Tax receipts and demand notices paid
  7. Plot allocation and payment receipts

Banks and later buyers look for this pack. Until consent or C of O is registered, you have paid for land but the government has not recorded you as the holder.

If you will build

Title is not a building permit. After the pack above: planning / building-plan approval, estate setback and house-type rules, then materials from the Wohiri yard.

Where to file

Lagos plots: Lagos State Lands Bureau. Aba and other Abia plots: Abia Ministry of Lands, Umuahia or Aba zonal office. Fees are on the bureau’s demand notice — not a percentage you copy from the internet.

Typical time: a few months if the file is clean; six to twelve months or more if a new C of O is required.
