Deed of indemnity

Sign this before you pay for a plot or list an estate. It protects Great Comfort Properties and Luxury Homes Ltd and you: you confirm what you inspected, what title you are taking, and that you will not hold Wohiri for claims that sit with the land, the community, or (for partner listings) the listing firm.

Deed of Indemnity

Between the undersigned and Great Comfort Properties and Luxury Homes Ltd

WHEREAS the Company operates Wohiri (wohiri.com) for the sale of plots, house specification, and building materials; AND WHEREAS the undersigned wishes to buy a plot on that platform; NOW THIS DEED WITNESSES that the undersigned agrees as follows:

  1. 1.I have inspected the plot (or I waive inspection) and accept it as it stands, including access, beacons, and neighbourhood works shown on Wohiri.
  2. 2.I know that under the Land Use Act 1978 the governor holds the land. What I buy is a right of occupancy. Great Comfort Properties and Luxury Homes Ltd (“the Company”) helps assemble the sale file; the Lands Bureau records title.
  3. 3.Title on a plot may be Certificate of Occupancy, gazette, excision, Deed of Assignment, or Governor’s Consent in progress. I will read the estate page and ask in writing before I pay if the root of title is unclear.
  4. 4.I indemnify the Company, Wohiri, their directors, staff, and agents against loss, claim, or cost that arises from my use of the land, my builders, my visitors, or any person I bring onto the plot.
  5. 5.After allocation, community dispute, government acquisition, or a third-party claim that was not known to the Company when I paid is not a ground for me to sue the Company beyond any refund the Company puts in writing.
  6. 6.Hold 30%, 3 / 6 / 12 month plans, and pay-in-full follow the prices on Wohiri. Spread fees are part of the price of time. I will not treat a hold as a completed sale until the stated payment is in.
  7. 7.Building requires planning approval and estate covenants. A house picture or 3D view is illustrative, not a warranty of finishes or setback.
  8. 8.If the estate is listed by a partner firm, that firm warrants its title. Wohiri is the platform. I will pursue that firm first for a defect in their title papers.
  9. 9.This indemnity is governed by the laws of the Federal Republic of Nigeria. Courts in Lagos State or Abia State (as the plot sits) may hear a dispute.
